Un elettrodotto è più importante del paesaggio?
Il Ministero dello sviluppo economico vuole l’elettrodotto tra la Sicilia e la Calabria, le popolazioni no. Vorrebbero tutelare il paesaggio e la salute. Terna, l’operatore nazionale delle reti per la trasmissione dell’energia elettrica, pare lo voglia a tutti i costi. L’opera riveste particolare importanza per tutto il territorio nazionale?
Anche le opere ritenute di interesse nazionale, realizzate dalle grandi aziende statali, sono soggette ai vincoli paesaggistici, lo prevede la nostra Costituzione. Il Paesaggio ha un alto valore socio-economico. “No elettrodotto”: petizioni, manifestazioni, appelli al Governo nazionale e al Capo dello Stato… Adesso qualche problema per chi se ne fregato o ha fatto finta di non sapere.
Terna, l’operatore nazionale delle reti per la trasmissione dell’energia elettrica, tra la Sicilia e la Calabria ha progettato e realizzato un nuovo elettrodotto che collega l’isola alla penisola. Un’opera mastodontica: centocinque chilometri di lunghezza complessiva, di cui trentotto sottomarini, 700 milioni di euro d’investimento.
Da Rizziconi, in Calabria, i cavi s’immergono nel mar Tirreno a Favazzina, per poi approdare in corrispondenza del torrente Gallo a Villafranca Tirrena, in Sicilia, da dove parte il collegamento aereo, che attraversa tutta la fascia collinare del versante tirrenico del messinese fino alla stazione elettrica di Sorgente-Corriolo, a San Filippo del Mela.
L’elettrodotto è stato autorizzato dal Ministero dello sviluppo economico nel 2010, al termine di un iter – durato tre anni e mezzo e una fase di concertazione, conclusa nel gennaio 2007, con la firma di un “Protocollo d’intesa” tra Terna, Regione Sicilia, Provincia di Messina e tutti i Comuni interessati – con il quale è stata condivisa la localizzazione del nuovo elettrodotto. Ma con la popolazione Terna ha fatto pochissimi incontri, non sono mai stati sentiti i consigli comunali e tutte le decisioni sono state prese con delibere di giunta.
Nel 2010, quando inizia a diffondersi tra i cittadini dei comuni coinvolti l’esistenza del progetto, la preoccupazione per le possibili ricadute sulla salute e sul territorio ‒ già martoriato dall’inquinamento industriale ‒ dà il via al formarsi di comitati e movimenti “No elettrodotto” e partono le prime iniziative di lotta: petizioni, manifestazioni, appelli al Governo nazionale e al Capo dello Stato, tutti caduti nel vuoto. Si arriva anche a impugnare davanti al Tar del Lazio l’autorizzazione unica rilasciata per decreto dal Ministero: tre i ricorsi presentati, due dell’Associazione Mediterranea per la Natura (MAN) e uno sottoscritto da 101 cittadini. Il tribunale amministrativo però si pronuncia solo su quest’ultimo, nel 2012, con sentenza risultata favorevole a Terna [anche se si sta aspettando la fissazione dell’udienza davanti al Consiglio di Stato, ndr].
Ma c’è chi non si è arreso, non si è fatto comprare, non si è lasciato intimorire dal colosso Terna.
Nel maggio del 2013, Gianni Mento, della MAN, assistito da due battaglieri avvocati messinesi, Nino La Rosa e Carmelo Picciotto, presenta un esposto alla Procura della Repubblica di Messina.

Secondo quanto emerge dall’esposto e dai documenti allegati, il progetto di Terna e le relative autorizzazioni (tra cui l’autorizzazione paesaggistica rilasciata dalla Soprintendenza per i beni culturali e ambientali della Regione Siciliana con nota n. 6018 del 27 giugno 2007 e reiterata con nota n. 6156 del 31 agosto 2009) si pongono in insanabile contrasto con il Piano Paesaggistico dell’Ambito 9 della Regione Siciliana adottato nel dicembre 2009 e pubblicato nei comuni interessati nel gennaio 2010.
Il Piano individua i punti forti del patrimonio paesaggistico peloritano e i livelli di tutela da applicare con i relativi divieti. Individua inoltre, nel Comune di Saponara, un crinale secondario che scende dai Colli San Rizzo a Monte Raunuso passando per il Serro Tondo e lo pone sotto Tutela di Livello 3 con fascia di metri 200+200 ai lati, il massimo previsto, per la particolare rilevanza paesaggistica. Proprio in questo crinale Terna ha già installato uno dei tralicci, il n. 40, e ha proseguito i lavori per l’arredamento e la collocazione dei cavi.
Alla faccia del Piano e della tutela!
La denuncia dell’Associazione Man convince la magistratura messinese a disporre, a febbraio di quest’anno, il sequestro del traliccio n. 40. Misura cautelare che viene confermata anche dal Tribunale del riesame. Anche se, lo scorso 17 luglio, il pubblico ministero Liliana Todaro «rilevato che, pur permanendo immutato il quadro cautelare sotto il profilo del “fumus” del reato ipotizzato, appaiono affievolite le esigenze cautelari, sia avuto riguardo allo stato del procedimento, già in fase di completamento delle notifiche dell’avviso di conclusione delle indagini preliminari, che avuto riguardo alla sostanziale realizzazione dell’intera opera a cui accede il traliccio in sequestro».
A settembre, chiuse le indagini preliminari, la dottoressa Todaro cita in giudizio, per il 23 febbraio, l’ingegner Roberto Cirrincione, dirigente Terna, per la realizzazione del traliccio.
Insieme all’ingegnere è imputato Simone Dal Pozzo, amministratore della ditta CEIE Power s.p.a., che ha eseguito i lavori.
Coinvolti nel procedimento anche gli architetti Salvatore Scuto e Anna Piccione, rispettivamente ex Soprintendente ed ex dirigente dell’Unità Operativa VII della Soprintendenza di Messina, per avere concorso all’alterazione di bellezze naturali tramite l’omessa revoca dell’autorizzazione rilasciata e divenuta inefficace per via del sopravvenuto Piano Paesaggistico dell’Ambito 9.
Gli imputati rischiano da uno a quattro anni e un’ammenda. Il Codice Penale prevede anche l’eliminazione del traliccio e la riduzione in pristino dei luoghi.
Alla prima udienza il rilievo fatto dall’imputato Roberto Cirrincione, della mancata notifica allo stesso imputato e all’avvocato Giulia Bongiorno (che ha fatto il suo ingresso nel procedimento con la richiesta, poi accolta, di dissequestro del pilone 40, ndr), ha comportato il rinvio dell’udienza al 3 maggio 2016.
A causa del rinvio non si è potuto procedere alla costituzione di parte civile dell’Associazione MAN con l’avvocato Picciotto e dell’Associazione I Cittadini Villafranca Tirrena con l’avvocato Emanuela Vattemi.

«Il nocciolo della questione è ben rappresentato nella sentenza del tribunale del riesame che ha rigettato la richiesta di dissequestro avanzata nel mese di maggio» ‒ ha dichiarato l’avvocato La Rosa, che non condivide la decisione del pubblico ministero che ha disposto il dissequestro. «Noi riteniamo che i reati commessi siano ancora gravi perché l’architetto Anna Maria Piccione, sentita in fase d’indagine, aveva riferito che la Soprintendenza di Messina “non aveva ritenuto necessario avviare il procedimento per la revoca dell’autorizzazione dal momento che la linea elettrica nel Comune di Saponara insisteva su un crinale secondario in un tratto marginale, tenuto conto che la realizzazione dell’opera rivestiva particolare importanza per tutto il territorio nazionale”».
«Tali valutazioni non rientrano nei poteri dei funzionari della Soprintendenza – aggiunge l’avvocato Picciotto – che dopo aver redatto e adottato il piano paesaggistico hanno solo l’obbligo di farlo rispettare ».
«Anche le opere ritenute d’interesse nazionale, realizzate dalle grandi aziende statali, sono soggette ai vincoli paesaggistici, la cui preminenza, sulla scala dei valori, discende direttamente dal secondo comma dell’art. 9, della nostra Costituzione.
Quando si capirà – conclude La Rosa – che il Paesaggio ha un alto valore socio-economico, la situazione potrà cambiare».
E forse qualcosa sta cambiando.
Proprio una recente sentenza (n. 3652/2015) del Consiglio di Stato, dello scorso 23 luglio, ha fermato la realizzazione dell’elettrodotto previsto da Terna tra Udine e Re di Puglia.
Una pronuncia che, ribaltando le precedenti pronunce del Tribunale amministrativo regionale, richiama con forza al rispetto dell’art. 9 della Costituzione: «La Repubblica tutela il paesaggio e il patrimonio storico e artistico della Nazione».
Nella sentenza si legge che l’indeclinabilità della funzione pubblica di tutela del paesaggio, per la particolare dignità data dall’art. 9 della Costituzione, è stata del resto più volte affermata dalla giurisprudenza costituzionale con un costante susseguirsi di sentenze che non possono e non devono essere ignorate.
Il Consiglio di Stato, accogliendo i ricorsi, ricorda che la tutela del paesaggio è collocata, nel nostro ordinamento giuridico, al massimo rango essendo inserita tra i principi fondamentali della nostra Costituzione e non può essere subordinata ad altri interessi come quelli della società Terna S.p.A. che ritiene irrinunciabile ed indispensabile la realizzazione del suo elettrodotto.
