Voti in cambio di appalti: quel pactum sceleris tra mafia e politica
Secondo l’impianto accusatorio i “mazzarroti” – una cellula della famiglia mafiosa di Barcellona Pozzo di Gotto (ME) – avrebbero dato i loro voti al candidato sindaco Salvatore Lopes per farlo eleggere nelle elezioni del 2007; il futuro sindaco in cambio avrebbe dato loro appalti per lavori pubblici e concessioni per l’apertura di attività commerciali.
Il sindaco Lopes avrebbe piegato «scientemente l’azione amministrativa» per «saldare il debito assunto» – si legge nell’ordinanza firmata dal gip Micali. Il pentito D’Amico rafforza l’ipotesi accusatoria provocando la reazione del dottor Lopes, che afferma: «Il patto con il Calabrese non esiste!». C’è un piccolo particolare: per ottenere quei pochi voti alcuni elettori sono stati minacciati anche con la pistola – si legge negli atti.
Un pastore e uno stimato chirurgo, entrambi con la passione per la politica. Ma il primo non è in realtà un semplice pastore. È Tindaro Calabrese, boss emergente del clan dei mazzarroti (una delle diverse diramazioni della mafia barcellonese), almeno fino all’aprile del 2008, quando la sua ascesa criminale ai vertici della “famiglia” è stata interrotta dal suo arresto nel corso dell’operazione del Ros Vivaio.
Le strade dei due si sarebbero incrociate in occasione delle elezioni amministrative in provincia di Messina nel 2007 quando il dottor Salvatore Lopes era candidato a sindaco del Comune di Furnari. Fu eletto con uno scarto di soli diciassette voti sul suo diretto avversario.
Semplicemente diciassette voti.
Secondo quanto rivela il collaboratore Carmelo D’Amico – ex capo dell’ala militare dei barcellonesi, oggi collaboratore di giustizia – l’esito di quelle elezioni sarebbe però stato deciso in un incontro a Barcellona Pozzo di Gotto in una tenuta in contrada Cavaleri, tra lo stesso D’Amico, e Tindaro Calabrese, che chiese al boss il permesso di poter schierare i mazzarroti a sostegno del candidato Lopes.
Tutto ciò viene a galla dalle nuove rivelazioni rese dal D’Amico, i cui verbali sono stati depositati dal sostituto procuratore della Dda di Messina Angelo Cavallo al processo originato dall’operazione antimafia Torrente, che vede tra gli imputati anche Calabrese e il dottor Lopes.
L’ex primo cittadino – accusato di concorso esterno in associazione mafiosa – secondo la Dda, una volta eletto avrebbe subito ricambiato il favore per l’appoggio ottenuto dai mazzarroti, piegando «scientemente l’azione amministrativa – si leggeva nell’ordinanza firmata dal gip Micali – della cui direzione era stato investito al precipuo fine di saldare il debito assunto». Perciò concedendo appalti per lavori pubblici e concessioni per l’apertura di attività commerciali.
Il “patto” prevedeva inoltre, la spartizione tra le imprese “amiche” dei lavori di “somma urgenza” affidati in occasione dell’alluvione del dicembre 2008 nei comuni di Mazzarrà Sant’Andrea e Furnari.
Nell’interrogatorio del 23 ottobre 2014, il collaboratore Carmelo D’Amico ha dichiarato che Tindaro Calabrese gli disse che «si era accordato con il Lopes affinché lui sostenesse la candidatura del Lopes stesso che, in cambio, una volta divenuto sindaco, si sarebbe sdebitato facendo ottenere a Tindaro Calabrese, o a chi per lui, lavori pubblici nell’ambito del comune… Tindaro Calabrese mi disse che quell’accordo intervenuto fra lui stesso e Lopes era avvenuto per iniziativa di Lopes. E Calabrese mi disse che si sarebbe impegnato per procurargli i voti».
«Ricordo – prosegue il racconto di D’Amico – che quando Calabrese mi riferì di quest’accordo, mi disse che Lopes ormai era “nelle nostre mani”. Con questa espressione Calabrese intendeva che Lopes era nelle sue mani, quindi anche nelle mie», in pratica era «a disposizione dell’intera organizzazione. Io gli diedi lo “sta bene”».
Calabrese – secondo quanto affermato dal pentito – «si fece prendere tantissimo» da quel patto stretto con il candidato, impegnandosi a fondo per procurare quei voti in suo favore e non fare cattiva figura. «Calabrese esercitò forti minacce praticamente nei confronti di tutti gli elettori di Furnari e, in qualche occasione, arrivò a minacciarli anche con la pistola. Specifico che queste cose mi furono riferite espressamente da Calabrese».

«Fu anche Arcidiacono (Leonardo Arcidiacono è imputato nello stesso processo, ndr) a dirmi che, se fosse salito il sindaco Lopes, costui si sarebbe sdebitato con il Calabrese e con gli altri soggetti che avevano procacciato i voti per lui, facendo assegnare in loro favore lavori da parte del comune di Furnari. Mi risulta che in effetti dopo quelle elezioni, il sindaco Lopes fece assegnare un lavoro dell’entità di circa 500.000 euro, da svolgersi a Portorosa».
Quel lavoro «venne assegnato a Santino Bonanno (imprenditore furnarese – condannato in primo grado a sette anni per concorso esterno in associazione mafiosa nel processo Zefiro in merito alla gestione dei lavori per la realizzazione dell’impianto eolico denominato “Alcantara–Peloritani” – ritenuto dagli inquirenti “socio” occulto dell’ex capo dei mazzarroti Carmelo Bisognano, con il quale avrebbe intessuto intensi rapporti di lavoro e di amicizia. Rapporti intrattenuti, dopo l’arresto di Bisognano, con il nuovo capo Tindaro Calabrese, ndr), e dunque a Tindaro Calabrese. In pratica, il lavoro lo prese formalmente Santino Bonanno ma gli interventi furono eseguiti anche da Calabrese».
Le dichiarazioni di Carmelo D’Amico hanno provocato la reazione del dottor Lopes che, in una lettera pubblicata lo scorso novembre dal quotidiano messinese Gazzetta del Sud (che aveva anticipato le dichiarazioni del collaboratore, ndr), ha affermato che «Il patto con il Calabrese non esiste!».
Secondo l’ex sindaco, l’appalto citato da D’Amico era stato vinto da «una ditta di Catania», in seguito a un bando di gara indetto dalla precedente amministrazione.
Tale ditta, successivamente, subappaltava una parte del lavoro, per un importo di circa 80.000 euro, al Bonanno.
«Invero – si legge nella replica –, nell’ipotesi di subappalto, l’amministrazione, previa verifica della documentazione da parte degli uffici preposti e in assenza di motivi ostativi, non può far altro che prendere atto del contratto che la ditta aggiudicataria stipula con la subappaltante».

Prima delle rivelazioni del collaboratore l’“interesse” manifestato dai mazzarroti per quelle elezioni era però già emerso nell’ambito dell’operazione Vivaio.
«Nelle elezioni di Furnari – si leggeva nell’ordinanza del gip Alfredo Sicuro – Calabrese Tindaro ha appoggiato la lista capeggiata da Salvatore Lopes, contrapposta a quella di Mario Foti nella quale era candidato anche Bonanno Santi».
Nell’ordinanza si leggeva ancora di come Calabrese – intercettato nella sua auto con il sodale Leonardo Arcidiacono – commentava «l’esito delle elezioni favorevole per la lista di Lopes da loro sostenuta. In questo contesto Calabrese riferiva all’amico di essersi rivolto a tale N.P., vicino di casa di Bonanno, il quale era apertamente schierato con la lista di Foti… Calabrese aveva invitato P. a non votare prima di parlare con lui… quando si era incontrato con il predetto gli aveva “suggerito” di dirottare i dodici voti che controllava sulla lista di Lopes, salvaguardando il proprio voto per Bonanno… tale sollecitazione non era stata accolta di buon grado da P. il quale, solo dopo essere stato insultato da Calabrese, si era risolto ad assecondarlo».
Il gip riporta come «tali voti, a detta di Calabrese, erano risultati decisivi per come egli si era premurato di far sapere a Lopes Giulio, fratello del sindaco, “perché dodici voti… quelli sono i voti con i quali abbiamo vinto… quelli sono stati gli ultimi voti truccati… e infatti io gliel’ho detto a Giulio”».
«La lista Lopes – concludeva il gip – ha alla fine prevalso su quella di Foti per diciassette voti, giustificando le affermazioni di Calabrese e Arcidiacono circa la decisività del loro contributo alla causa del neo sindaco».

Gli esiti di quell’indagine furono decisivi per l’invio da parte del prefetto di Messina di una commissione di accesso agli atti amministrativi del Comune di Furnari.
La commissione aveva il compito di accertare come nell’assegnazione dei lavori di somma urgenza conseguenti agli eventi alluvionali del dicembre 2008 e gennaio 2009, il sindaco Lopes avesse scelto direttamente le ditte per i lavori di ripristino della viabilità e delle condizioni di sicurezza e che l’assegnazione degli incarichi in alcuni casi avvenne senza tener conto dell’iscrizione alla Camera di commercio e del tipo di attività richiesta. Inoltre, gran parte di quei lavori pare siano stati eseguiti da imprese che presentano elementi di collegamento con soggetti coinvolti nell’operazione Vivaio o comunque con precedenti anche per associazione mafiosa.
Nel dicembre 2009, ha luogo lo scioglimento degli organi amministrativi per infiltrazione mafiosa nella gestione dell’ente, e nel novembre 2010 l’operazione antimafia Torrente – nel corso della quale venne arrestato anche l’ex sindaco Salvatore Lopes.

Nelle precedenti udienze del processo Torrente, di quelle elezioni e di quei lavori ha parlato anche un altro pentito della mafia tirrenica, Carmelo Bisognano (anche lui imputato nel medesimo procedimento, ndr) che ha raccontato di un incontro particolare avvenuto il 13 febbraio del 2009 con l’allora sindaco Lopes. I due s’incontrarono per caso a Furnari, e parlarono a lungo.
Il sindaco Lopes aveva confidato di essersi recato in mattinata a Messina dove aveva ricevuto notizie ben poco confortanti circa la possibilità di dare corso a nuovi lavori attraverso lo strumento delle ordinanze di somma urgenza («eh non ne possiamo fare più … oggi ho parlato, oggi sono stato a Messina»). Nell’occasione, però Bisognano sembrava piuttosto mosso da ben altra urgenza.
«Io – racconta Bisognano –, una volta appurate tutte le vicissitudini circa le elezioni del 2007, mi innervosii e cercai di chiarire la questione con lui: volevo far capire al sindaco che lui, comportandosi in quel modo, non aveva ben capito chi fosse il vero referente dell’organizzazione mafiosa sul territorio, nel senso che ero io e non Calabrese Tindaro ad esserlo. Quando io uso l’espressione “non dobbiamo fare confusione con i ruoli”, rammentavo al sindaco che l’unico referente dell’organizzazione mafiosa sul territorio ero io, e non Calabrese Tindaro. Quest’ultimo, infatti, durante la mia detenzione, aveva soltanto assunto la veste di “reggente” e non poteva arrogarsi un’autorità che non gli competeva.
Io “insultai” il sindaco che si era sottoposto a quel tipo di mercificazione con Calabrese Tindaro, consentendo che costui lo sostenesse in modo così spudorato».
I due parlarono di un “impegno” in relazione ad alcuni lavori pubblici, concetto spiegato dal Bisognano:
«Quando il sindaco mi rivolse la frase “comunque se passa tutti a te pensiamo, per ora siamo al …”, costui si riferiva al fatto che qualora in futuro ci fossero stati degli altri lavori da assegnare direttamente con la procedura della “somma urgenza”, a causa dell’alluvione che si era verificata in quel periodo, era ben disponibile a tenermi in considerazione, al contempo, egli riconosceva il mio ruolo di capo dell’organizzazione sul territorio, al posto di Calabrese Tindaro».

Nel corso delle ultime udienze si è assistito all’esame di vari collaboratori di giustizia sulla figura dell’imprenditore Bonanno, ritenuta rilevante dalla pubblica accusa, tanto da chiedere l’acquisizione della sentenza di primo grado del processo Zefiro. Stante l’opposizione del collegio di difesa, il tribunale ha disposto un nuovo esame dei collaboratori Gullo, Bisognano e Truscello. Del ruolo che il Bonanno avrebbe avuto nell’organizzazione, quale imprenditore a disposizione, hanno parlato anche i pentiti Siracusa, Campisi, Castro e Francesco D’Amico.
Prevista per la prossima udienza del 23 giugno la deposizione dell’ex capo militare dei barcellonesi Carmelo D’Amico.
