La vicenda giudiziaria dei Virga
Siamo nel 2014, quando l’allora presidente dell’Ufficio misure di prevenzione Silvana Saguto mette sotto sequestro il patrimonio dei fratelli Virga, imprenditori di Marineo nel settore delle cave e del calcestruzzo. Il sequestro è ritenuto ed è comunicato alla stampa uno dei più grandi mai effettuati, perché, secondo le stime della DIA, si tratterebbe di un miliardo e 600 milioni di euro. Finiscono sotto sequestro 33 imprese di calcestruzzo, 700 tra case, ville, immobili, 89 rapporti bancari, 40 assicurativi e una quarantina di mezzi da trasporto appartenenti, oltre che a Gaetano Virga, ai fratelli Carmelo, 66 anni, Vincenzo, 78 anni, Anna, 76 anni, Francesco, 71 anni e Rosa, 58 anni. Il sequestro è stato chiesto dal direttore della DIA, Nunzio Antonio La Ferla. Le indagini patrimoniali sono state coordinate dal procuratore aggiunto Bernardo Petralia.
Secondo gli inquirenti i Virga sarebbero stati organici alla famiglia mafiosa di Marineo, legata al mandamento di Corleone e sarebbero riusciti, nel tempo, a sviluppare e a imporre il loro gruppo di imprese, soprattutto nel campo dell’edilizia, anche attraverso il cosiddetto “metodo Siino”, consistente nell’organizzazione di “cartelli” di imprenditori, per l’aggiudicazione pilotata degli appalti pubblici. E tuttavia la storia non poteva non incuriosire, proprio per le sue dimensioni economiche: possibile che in uno scordato paese delle Madonie esistesse gente così ricca?
Uno dei fratelli Virga, in un’intervista a Telejato, ha detto che al momento la sola azienda attiva si occupa di lavorazione di inerti e che di tutto il resto citato dalla DIA non c’è più niente, in gran parte si tratta di vecchie aziende aperte e chiuse in poco tempo, quello che poteva bastare a un cantiere per prendere e completare un appalto. E, del resto, è la stessa Saguto, a confermare, in un’intercettazione, che si tratta di stime gonfiate: “Non è che ti pare questo sequestro chissà che è, con tutte ste storie….sono tutte case”. I Virga, dopo il sequestro si sono acconciati in una piccola azienda agricola di un cognato, pure questa sotto sequestro.
Amministratore giudiziario è nominato uno dei tanti uomini di fiducia della dott.ssa Saguto, il commercialista Giuseppe Rizzo, già titolare di altri incarichi. Dalle intercettazioni e dagli atti del processo di Caltanissetta risulta che Rizzo sia stato fortemente “raccomandato” alla Saguto dal colonnello della Finanza Nasca, allora in forza alla Dia di Palermo e che la Saguto si sia dovuta piegare alla richiesta, pur ritenendolo “un ragazzino da niente”, al quale progettava di affiancare il suo “pupillo” Carmelo Provenzano. Di fatto a Rizzo, dopo qualche anno è stato revocato l’incarico, dal successore della Saguto, Montalbano, che gli ha contestato di avere eseguito dei pagamenti da due mila e 200 a quattro mila e 200 euro ciascuno a ventotto soggetti, con il ruolo di collaboratori, senza l’autorizzazione scritta del giudice delegato. Con il successore di Rizzo, il catanese Giovanni Privitera, non è cambiato molto, nel senso che costui si è limitato a poche visite, lasciando la cava trascinarsi nel suo inevitabile degrado con diversi operai che hanno perso il posto di lavoro o che hanno ricevuto a spezzoni e ad acconti il compendo mensile.
Una notizia che gran parte dei giornali hanno finto di ignorare è che, da molti anni prima del sequestro, Gaetano Virga ha collaborato con la giustizia e ha presentato numerose denunce contro vari tentativi di estorsione. Le sue testimonianze hanno consentito di arrestare cinque persone ritenute i capimafia e gli esattori di Marineo. L’operazione dei Carabinieri, nel corso della quale finirono in manette Francesco Lo Gerfo, ritenuto il capomafia di Marineo, e Stefano Polizzi, presunto estorsore, aveva portato anche allo scioglimento per infiltrazioni mafiose del Comune di Marineo. Nel 2010, tra maggio e novembre, Polizzi avrebbe chiesto il pizzo a Gaetano Virga minacciandolo: “Ricordati che hai dei figli”, aggiungendo che “quando Polizzi è venuto nei nostri uffici ha affrontato mio zio molto animatamente. Li ho visti discutere da una finestra all’interno della nostra azienda a Marineo. Nella zona tutti sapevano quello che faceva Polizzi. Mio zio l’ha mandato via dicendogli che non avrebbe avuto un centesimo, ma si è ripresentato successivamente”. Virga da quel momento aveva fatto una coraggiosa scelta, diventando un punto di riferimento per gli imprenditori che rifiutavano di pagare il pizzo e ottenendo il sostegno di associazioni come Addio Pizzo, Libero Futuro e Fai. Nel processo contro Polizzi, che ne uscì assolto, e in altri cinque processi è stato assistito da Addio Pizzo.
Enrico Colajanni, presidente di Libero Futuro, ha confermato il percorso di riscatto da anni fatto da Gaetano Virga, al quale sono stati bruciati nel 2013 a ripetizione un centinaio di mezzi e che ha ottenuto anche un fondo di rimborso per le vittime danneggiate dalla mafia in un’inchiesta coordinata dai procuratori Vittorio Teresi e Leonardo Agueci. L’unica vecchia accusa nei suoi confronti è quella di turbativa d’asta, nel 1992.
Naturalmente le trombe dei giornalisti, alimentate da chi ha progettato il sequestro, si sono messe a suonare dicendo che ci troviamo davanti a una nuova strategia della mafia, quella di fingere di collaborare, e insinuando che le denunce e la partecipazione a Libero Futuro, erano tutti espedienti per salvare il patrimonio, secondo le interpretazioni di magistrati e investigatori, ma che non sono serviti a nulla.
Nel febbraio 2016 una troupe della televisione svizzera di lingua tedesca ha registrato un servizio proprio davanti all’azienda dei Virga, con la collaborazione di Telejato.
I legali dei Virga, avevano chiesto, senza ottenerlo, che le imprese passassero dall’amministrazione al controllo giudiziario con l’istituzione di un organismo di vigilanza, ma alla fine hanno vinto la battaglia perché, a sette anni di distanza, il 31 maggio 2021 è arrivata la svolta che ha messo fine a questa vicenda: il tribunale delle misure di prevenzione ha respinto la proposta, avanzata dalla Procura, di applicazione della misura della sorveglianza speciale e ha deciso la restituzione dei beni, ove si escluda “una parte residuale” di proprietà di Carmelo Virga. Gaetano Virga, attende di verificare che cosa sarà in realtà consegnato, ma soprattutto quali debiti siano stati accumulati e lasciati sospesi dall’amministrazione giudiziaria, ritenendo che, a una prima stima si tratti di circa 60 milioni, cifra di gran lunga superiore al valore di ciò che è rimasto e che non ha nulla a che fare con la cifra inizialmente data in pasto alla stampa.
Non è il primo e il solo caso in cui la collaborazione delle vittime del pizzo è usata come strumento per procedere nei loro confronti, utilizzando i dati da loro stessi offerti. Con l’avvertenza che, quando si parla di “vittime” non si tratta sempre di “verginelli”, di anime candide che non abbiano avuto contatti e rapporti con le cosche mafiose del loro territorio. In Sicilia succede. La verità è che i Virga hanno creduto nell’aiuto dello Stato, a sostegno delle loro scelte, ma che si sono illusi, essendosi trovati davanti alla linea d’azione della DIA, all’epoca del sequestro, e alla mancanza di scrupoli di Silvana Saguto che, nel periodo della sua gestione ha infierito, su imprenditori che da tempo avevano iniziato una scelta di collaborazione e ne ha depredato i patrimoni riducendo all’indigenza intere famiglie, salvo poi alla fine consegnare briciole e debiti.
