Caso Saguto: condannata l’ex giudice e una parte dei suoi complici

I giudici del processo contro Silvana Saguto e alcuni componenti della cricca che girava attorno a lei, sotto la presidenza di Andrea Catalano, sono rimasti per più di cinque ore chiusi in camera di consiglio e alla fine hanno comunicato le loro decisioni che, per quasi tutti gli imputati, dimezzano le richieste avanzate dai pm: otto condanne e tre assoluzioni.
- Silvana Saguto: otto anni e mezzo, più un risarcimento di mezzo milione di euro alla presidenza del Consiglio dei ministri che si è costituita parte civile. Caduta l’accusa di associazione a delinquere;
- Francesca Cannizzo, ex prefetto di Palermo e grande amica della Saguto, condanna a tre anni di carcere;
- Lorenzo Caramma, marito della Saguto, sei anni e due mesi;
- Gaetano Cappellano Seminara, uno dei principali manovratori e protagonisti del sistema Saguto, sette anni e sei mesi;
- Walter Virga, amministratore giudiziario, figlio del magistrato Vincenzo, un anno e dieci mesi;
- Roberto Santangelo, amministratore giudiziario, sei anni, 2 mesi e 10 giorni;
- Rosolino Nasca, colonnello della G.d.F in servizio alla DIA di Palermo: quattro anni;
- Carmelo Provenzano, docente alla Kore di Enna e amministratore giudiziario, sei anni e dieci mesi:
- Roberto Di Maria, docente alla Kore di Enna, due anni, otto mesi e 20 giorni;
- Maria Ingrao, moglie di Carmelo Provenzano, quattro anni e due mesi;
- Calogera Manta, cognata di Provenzano, quattro anni e due mesi;
- Emanuele Caramma, figlio della Saguto, sei mesi.
Sono stati assolti Vittorio Saguto, padre dell’imputata, Aulo Gabriele Gigante, amministratore giudiziario dei Niceta, e il giudice Lorenzo Chiaramonte per il quale la Procura aveva chiesto una condanna a due anni e mezzo.
Si chiude, in primo grado, una vicenda iniziata, ufficialmente, cinque anni fa, quando i telefoni dell’allora Presidente dell’ufficio misure di prevenzione e dei suoi amici vennero messi sotto controllo. La cosa non era avvenuta per caso o per iniziativa di qualche alto magistrato, come si è tentato di far credere. Dietro c’erano stati due anni di denunce da parte dell’emittente televisiva di Partinico Telejato, con una serie di testimonianze dirette di imprenditori vittime del sistema predatorio messo in atto presso il tribunale di Palermo e ai quali non era rimasto altra arma che quella di gridare al mondo la loro condizione di vittime di un sistema ingiusto. Per la verità a smuovere le acque era stato anche l’ex prefetto dell’Agenzia dei beni confiscati e sequestrati alla criminalità mafiosa Antonio Caruso: egli aveva denunciato pubblicamente e davanti alla Commissione Antimafia il perverso sistema che aveva messo nelle mani di pochi amministratori giudiziari un patrimonio immenso, sequestrato con la scusa del “sospetto” di collusioni mafiose. Denunce inascoltate, al punto che Caruso fu messo o andò in pensione. Le inchieste di Telejato scoprirono come dietro c’era un meccanismo ben lubrificato del quale erano membri i cosiddetti “quotini”, ovvero professionisti in “quota” alla Saguto e al suo pupillo-ispiratore Cappellano Seminara. Parcelle da milioni di euro, svendita e rivendita di mezzi di lavoro sequestrati, assunzioni di favore, incapacità gestionale e tant’altro. In pratica a Palermo si era affermata una nuova classe politica parassitaria, diversa, ma non troppo da quella mafiosa, che aveva spadroneggiato sino ad allora, in grado di controllare la città e la provincia e di arricchirsi in nome dell’antimafia. La Saguto agiva sicura di poter contare sull’appoggio e sulla protezione della corrente di “Magistratura Indipendente”, della quale facevano parte, assieme a lei, politici e magistrati ad altissimo livello. Per quasi dieci anni è stata ritenuta, come ebbe a dire Giancarlo Caselli, già Procuratore Capo, “la donna più potente di Palermo”. Potente e osannata da tutto il mondo dell’antimafia, oltre che da quello dell’informazione. Le spese pazze, sue e della sua famiglia si aggiravano sui 15 mila euro al mese, ma il magistrato poteva anche godere di spese fatte a suo debito, nelle attività che aveva posto sotto sequestro oltre che di favori vari da parte della potente cricca di amici ai quali affidava incarichi e amministrazioni. Tutto questo è caduto di colpo, come un castello di carta, anche se in piedi è rimasto il meccanismo legale al quale qualsiasi giudice “tipo Saguto” può ricorrere. Ed è proprio su questo che occorre fare una considerazione, ovvero rivedere alcuni passaggi di una legge nata al momento dell’emergenza mafiosa, ma utilizzata indiscriminatamente. Punti deboli di questa legge, secondo le direttive suggerite dall’Europa, sono il ricorso al sospetto come motivazione del sequestro, l’amministrazione equilibrata e continuativa dei beni sequestrati, il mancato rimborso agli imprenditori riconosciuti innocenti ed estranei al sodalizio mafioso e i tempi troppo lunghi del sequestro. Una proposta possibile per evitare questa divaricazione della legge è quella di una valutazione concordata e collegiale tra i vari settori giudicanti, da quello penale a quello preventivo, a quello investigativo, prima di procedere alla condisca definitiva dei beni. Ma sono cose che diciamo da molti anni, senza che qualcuno sia interessato a portarle avanti.
