A Partinico si discute sulle misure di prevenzione e sulla gestione dei beni sequestrati
Presentato il libro di Salvo Vitale “In nome dell’antimafia”.
È stato un interessante sabato pomeriggio. La sala Gianì era piena di gente venuta ad assistere alla presentazione del libro di Salvo Vitale “In nome dell’antimafia” – Cronache da Telejato – misure di prevenzione e gestione dei beni sequestrati. Ha aperto gli interventi Pino Maniaci, che ha fatto da coordinatore, ripercorrendo il lungo cammino dell’inchiesta cui è dedicato il libro, cominciato nel 2013, con una serie di persone colpite dalle misure di prevenzione e con i beni sequestrati, che sentivano il bisogno di rendere note le ingiustizie di cui erano rimaste vittime. Tutti erano incappati nelle grinfie della Saguto, che non aveva esitato a sistemare all’interno delle aziende sequestrate i suoi amici amministratori giudiziari con le loro parentele. Da allora si era aperto uno squarcio nel blindato sistema giudiziario, amplificato, contemporaneamente dalle denunce alla Commissione Antimafia dell’ex prefetto Caruso, alla guida dell’Agenzia dei beni sequestrati e confiscati alla criminalità mafiosa, recentemente scomparso. L’opera di Telejato, attraverso gli articoli dell’autore, è stata quella di aprire squarci nel sistema, di denunciare le storture causate sia dalla legge, sia dalla cattiva gestione che di essa si faceva. Tutto questo portava all’incriminazione e poi alla condanna di una parte dei personaggi del cerchio magico della Saguto, ma anche, per una sorta di effetto di ritorno, alle vicende giudiziarie di Pino Maniaci e di Salvo Vitale, che avevano il sapore di una rivalsa, quasi a dimostrare, come ebbe a dire il procuratore Teresi: “non abbiamo bisogno dell’antimafia di Pino Maniaci”.
L’avvocato Bartolomeo Parrino ha fatto una sintesi storica delle misure di prevenzione, a cominciare da quelle introdotte dal Fascismo contro i dissidenti politici, per fermarsi alla legge Rognoni La Torre, che aggrediva i patrimoni dei mafiosi, ma consentiva di mettere le mani anche sui beni di presunti mafiosi, la cui presunzione di colpevolezza era affidata all’arbitrio del magistrato. Parrino ha cercato anche di tracciare il confine che divide la verità processuale che è una ricostruzione giudiziaria dei fatti, alla verità storica e realtà e la differenza tra il procedimento penale e quello di prevenzione, per arrivare all’assurdo che chi è assolto penalmente, spesso si vede confiscare tutti i beni “preventivamente”.
L’avvocato Dell’Aira ha citato una serie di casi di cui si è occupato, per sostenere alla fine che, a suo parere le misure di prevenzione sono necessarie, ma hanno bisogno di una profonda revisione della legge: le ha paragonate al possesso di una pistola senza sicura. Singolare il caso dei Virga, di cui si parla nel libro, che avevano denunciato i loro estorsori, poi assolti, che avevano subito un centinaio di attentati ai propri mezzi di lavoro, che alla fine avevano avuto anche un risarcimento dello stato, chiesto dai magistrati Teresi e Agueci, e che un mese dopo si sono visti sequestrare tutti i loro beni, che, dopo anni di vicende giudiziarie, alla fine sono stati loro restituiti, ma privi di valore.
Non previsto in programma l’intervento di Pietro Cavallotti, che ha animatamente esposto le critiche a una legge che ha distrutto i beni della sua famiglia e le proposte presentate in Parlamento dall’associazione “Nessuno fermi Caino“, di cui fa parte, per una modifica della normativa vigente
Salvo Vitale ha concluso parlando della struttura del libro, che pone lo sguardo su un patrimonio di circa 50 miliardi, spesso destinato al disfacimento, sia per cattiva amministrazione, sia perché intercorre troppo tempo dal momento del sequestro alla confisca, all’assegnazione del bene ai comuni, alla sua destinazione finale e alla sua eventuale ristrutturazione, per la quale occorrono finanziamenti. Ha parlato poi dell’operato degli amministratori giudiziari, per i quali è più semplice mettere in liquidazione il bene affidato, che continuare a renderlo produttivo, ha evidenziato che costoro non dovrebbero essere pagati dall’azienda, ma dallo Stato e nominati non sulla fiducia, ma secondo una graduatoria. Ha citato poi alcuni dei cinquanta casi giudiziari di cui si occupa nel libro, cui sono stati restituiti i beni, unitamente, nei capitoli finali, alle vicende processuali di Maniaci, della Saguto e dei suoi complici, concludendo che la riforma della legge è una priorità, ma non viene ritenuta tale dal governo, e che la Sicilia, che ha il primo posto in Europa per numero di sequestri, si trova a dover fare i conti anche con le strozzature alla sua già debole economia, causate dalle discrasie, dagli arbitri, e dalle disfunzioni di questa legge.
