Luigi De Magistris, un uomo “fuori dal sistema”
La presentazione del libro a Palermo, presso la Libreria Tante storie, via Ariosto 27 A/B, prevista per il 6 ottobre, è stata spostata al 13.10, stessa ora, stesso posto, stessi relatori
Luigi De Magistris ci sta provando. Le elezioni sono arrivate troppo presto e non hanno consentito il paziente e lungo lavoro di raccordo e di alleanza con il variegato popolo della sinistra. Una cosa gli è parsa subito chiara, che un programma di rigenerazione della società non può passare che dalla giustizia sociale e da un’equa distribuzione delle ricchezze. Inutile cercare tale prospettiva nel PD, ormai totalmente asservito alle logiche del capitalismo, e pertanto l’unica sponda non poteva che essere rappresentata dai pianetini che si muovono a sinistra del PD. Dopo la raccolta delle 50 mila firme per presentare il simbolo, la speranza di superare il tetto del 3% si è infranta con un deludente 1,4% che comunque De Magistris considera una base e un punto di partenza per costruire la sinistra nei giorni che verranno In tal senso si muove su una strada stretta, ma che, per la sua radicalità e per la sua correttezza politica, per la sua onesta e per una certa purezza ideologica ha in passato fatto da riferimento a vari esponenti della magistratura, in gran parte criminalizzati dai berluscones con l’appellativo di “toghe rosse”, da Piero Grasso, a Peppino Di Lello, a Ingroia, a Caselli e, ultimamente a Scarpinato e Cafiero De Raho.
In questa frase si può leggere tutto il suo impegno e il suo rapporto con le istituzioni, al servizio di tutti i cittadini: «Mi è stato impedito di proseguire il mio lavoro di magistrato fedele alla costituzione, ma mi sono rialzato, cercando di applicare la nostra carta fondamentale in un altro modo. Si può essere nelle istituzioni e fuori dal sistema: il potere può e deve essere messo al servizio dei senza potere.»
Nella sua personale storia c’è una breve esperienza di eurodeputato e presidente della Commissione per il controllo dei bilanci del Parlamento europeo (2009-2011) nell’Italia dei Valori e la decennale esperienza (2011-2021) come sindaco di Napoli, eletto fuori da ogni schieramento politico. La sua carriera di magistrato fu interrotta, in Calabria, mentre stava indagando sul torbido intreccio di mafie, massoneria e lobby di potere appartenenti a tutti i partiti. Costretto a lasciare la toga, ha continuato la sua carriera di uomo “libero” da alleanze e compromessi e il suo lavoro politico cambiando interamente il modo di amministrare a Napoli, diventata con lui la città dell’acqua pubblica, dei beni comuni, del riscatto culturale e turistico, sconfiggendo l’emergenza rifiuti, le infiltrazioni della camorra, malgrado l’ostilità del governo nazionale e di quello regionale.
Il suo recente libro “Fuori dal sistema” racconta le sue esperienze , l’ostilità del sistema di potere di cui fanno parte le varie componenti di potere dello stato, della magistratura, all’imprenditoria spesso corrotta e infiltrata da componenti criminali: indagini che aprirono un fascio di luce su un verminaio che interessava magistrati, ministri uomini politici di provenienza varia, e che costarono a De Magistris la perdita dell’inchiesta, l’accusa di incompatibilità ambientale, e quindi di trasferimento e infine l’abbandono della magistratura. Il libro non è solo un racconto di quel che succede in Italia, coperto dal silenzio complice di tutti i gangli del potere, ma traccia anche la prospettiva di costruire una vera e propria alternativa antisistema che coinvolga gli spiriti liberi nelle battaglie per l’ambiente, la dignità del lavoro, la pace, la lotta alle mafie, la sanità e la scuola pubblica.
Ecco una dimenticata dichiarazione di De Magistris pubblicata sul sito di Grillo nel lontano 19-01-2009, che non ha perso la sua validità: ”L’altro giorno, in uno dei tanti viaggi tra Napoli e Catanzaro, ascoltavo la bellissima canzone di Francesco De Gregori e mi venivano in mente frammenti di storia scritti da magistrati della Repubblica italiana. Pensavo al coraggio del Procuratore della Repubblica di Palermo, Gaetano Costa, che, da solo, si assunse la responsabilità di firmare degli ordini di cattura, al coraggio di Rosario Livatino ed Antonino Scopelliti che non piegarono la testa e decisero di esercitare il loro ruolo con rigore ed indipendenza, a quello di Paolo Borsellino che consapevole di quello che stava accadendo ai suoi danni cercava di fare presto per giungere alla verità e per comprendere anche le ragioni della morte di Giovanni Falcone e degli uomini della sua scorta. Pensavo a quanta mafia istituzionale accompagna tanti eccidi accaduti negli ultimi trent’anni. Pensavo a quello che sta accadendo in questi mesi in cui si consolidano nuove forme di “eliminazione” di magistrati che non si omologano al sistema criminale di gestione illegale del potere e che pretendono, con irriverente ostinazione, di adempiere a quel giuramento solenne prestato sui principi ed i precetti della Costituzione Repubblicana, nata dalla resistenza al fascismo. Pensavo a quello che possono fare i singoli magistrati oggi per opporsi ad una deriva autoritaria che ha già modificato di fatto l’assetto costituzionale di questo Paese. Pensavo a quello che può fare ogni cittadino di questa Repubblica per dimostrare che, forse, ormai, l’unico vero custode della Costituzione Repubblicana non può che essere il popolo, con tutti i suoi limiti.
