Togliere i figli ai mafiosi è giusto?
I minori figli di mafiosi sono o dovrebbero essere equiparati ai figli di tossicodipendenti o di coloro che usano violenza fisica nei rapporti con i figli e allontanati dai loro genitori.
Il Consiglio Superiore della magistratura oggi, in una risoluzione della Sesta Commissione pone un problema, quello dei figli dei mafiosi, per i quali si propone la decadenza o la limitazione della potestà genitoriale al fine di allontanarli da un ambiente ad alto rischio per il loro sviluppo psicofisico, disponendone l’affidamento a strutture che siano fuori dalla regione di provenienza. I minori figli di mafiosi sono o dovrebbero essere equiparati ai figli di tossicodipendenti o di coloro che usano violenza fisica nei rapporti con i figli e allontanati dai loro genitori. Il tutto con l’intenzione di “proteggere il minore dal pregiudizio che gli deriva dalla violazione del suo diritto a essere educato nel rispetto dei principi costituzionali e dei valori della civile convivenza”.
Già diversi anni fa ci siamo occupati di questa spinosa questione in un articolo intitolato Piccoli mafiosi crescono, evidenziando come la famiglia sia il primo nucleo da cui partono gli stimoli e da cui si sviluppa un certo tipo di educazione che poi i bambini si porteranno appresso per il resto della vita. Se poi si tratta di famiglie mafiose, ci sono tutte le possibilità che da queste vengano fuori rampolli che ereditano, oltre che il cognome, il modo di essere, di pensare, di valutare tutto quello che sta intorno a loro, cioè vengano fuori altri mafiosi. In realtà, se facciamo una breve retrospettiva troviamo che i nuclei familiari mafiosi sono mafiogeni, trasmettono mafia, che tutti i più grandi, ma anche buona parte dei più piccoli mafiosi sono figli, nipoti, parenti di altri mafiosi, da Totò Riina a Messina Denaro, agli Inzerillo, ai Bontade, ai Greco di Ciaculli, ai Vitale e ai Nania di Partinico, ai Badalamenti e ai Di Trapani di Cinisi, ai Provenzano di Corleone. L’elenco è infinito e il problema posto oggi dal CSM era stato da noi esposto quattro anni fa nell’articolo sopra citato. Possono sempre emergere problemi di esperti o presunti tali psicologi o pedagoghi che invece partono dal presupposto che il luogo naturale per la serena crescita del minore, è quello della sua specifica famiglia e dei suoi naturali genitori e che, tolti ai loro affetti i minori possano ricevere traumi e alimentare condizioni che poi li renderanno disadattati e violenti, specialmente quando, raggiunta la maggiore età, saranno svincolati dall’obbligo di rimanere nella famiglia o nella comunità cui sono stati affidati.
Quindi non è un problema semplice e ogni caso va trattato con la dovuta delicatezza, senza disposizioni autoritarie che qualche volta si sono rivelate più nocive del male che si voleva combattere. Ci sono anche stati dei casi in cui i figli dei mafiosi si sono resi conto di quello che erano i genitori e, nel momento in cui hanno cominciato a pensare con la propria testa hanno preso le distanze. Non sono molti, ma l’esempio più eclatante è quello di Peppino Impastato, cui sono seguiti altri che hanno scelto la via del rispetto delle regole della società in cui vivono. Si incrociano in tutto ciò fattori diversi, da ciò che sanno trasmettere le scuole a quello che caratterizza il cosiddetto branco, ovvero il nucleo e il gruppo di amicizie che gira intorno ai ragazzi, ma soprattutto il brodo di cultura derivante dall’ambiente.
È per questo che la proposta del CSM prevede anche l’allontanamento del minore dalla regione di provenienza. Anche qua la proposta va letta con cautela e fuori dalla logica nordista secondo la quale le regioni meridionali (si citano esperienze dei tribunali di Reggio Calabria, Napoli e Catania) sono caratterizzate da mafia o mafiosità, mentre quelle del nord Italia sarebbero esenti da questi mali che invece ormai sono presenti in ogni angolo del paese. A meno che non si pensi di deportarli in Groenlandia o in un’isola tutta per loro. E allora tutto va valutato con attenzione, perché, tanto per ripetere una frase del Gattopardo, “bisogna pensarci quando sono piccoli. Già a dieci anni è troppo tardi”.
