Amministratore giudiziario, con i soldi dei boss aveva realizzato una propria azienda
Difficile ricostruire il momento in cui a Ruggero Rizzuto venne affidato l’incarico di amministratore giudiziario dei beni prima sequestrati e nel 2012 definitivamente confiscati, ai boss Rosario Spatola e Salvatore Inzerillo, uccisi nel 1981 dalla banda dei Corleonesi di Totò Riina. Di fatto Rizzuto è in azione nel 2005 e sino al 2008 usa i due conti correnti sequestrati ai due boss come una sorta di bancomat personale, prelevando somme consistenti, sino a 621.487, senza l’autorizzazione del competente magistrato. Che qualcosa non andasse nell’allegra gestione di Rizzuto lo avevano intuito anche i magistrati, che lo avevano iscritto nel registro degli indagati con l’accusa di peculato continuato, riscontrando che non era stato depositato il rendiconto finale. Polizzi muore, colpito da un male incurabile nel 2018 e l’indagine sul suo conto sembra chiudersi con la sua morte. Che fine avevano fatto i soldi prelevati da Rizzuto? Con un’indagine minuziosa eseguita dagli agenti dell’Ufficio misure di prevenzione della Divisione anticrimine di Palermo si è scoperto che l’allegro commercialista “girava” o “investiva” i soldi dei boss in una cantina vinicola e in un oleificio realizzati in provincia di Agrigento su alcuni terreni di sua proprietà. Le quote della società sarebbero state trasferite a un erede, a quanto pare una figlia, mentre il commercialista è rimasto di fatto amministratore sino alla sua morte. Nel passato mese di maggio l’erede ha venduto un ramo dell’azienda per 928 mila euro: il prezzo della compravendita è stato accreditato su un conto corrente intestato alla società, e sul quale può operare l’erede dell’amministratore.
Il sequestro Rizzuto presenta alcune anomalie, al momento senza risposta:
- Il reato è stato commesso15-18 anni fa. Come mai il sequestro è scattato ora, allo scadere dei cinque anni dalla morte di Rizzuto?
- La somma sequestrata è di 779.476,31 euro, cioè di 158 mila euro in più rispetto a quella sottratta da Rizzuto. Si può ipotizzare che l’azienda agricola deve essere stata potenziata e migliorata, sino a giustificarne il suo aumento di valore: ma in questo caso i benefici correttamente realizzati sono pure da sottoporre a sequestro?
- Tra il prezzo di vendita e la somma sotto sequestro c’è una eguale differenza di 150 mila euro. Perché non è stata sequestrata l’intera somma? Sono problemi che giriamo al legale dell’erede di Polizzi.
Il provvedimento è stato chiesto dal procuratore Maurizio de Lucia e dal questore Leopoldo Laricchia e accettato dai magistrati dell’Ufficio Misure di prevenzione.
Il procedimento di prevenzione può essere applicato sino ai cinque anni della morte del titolare ed è attivo anche nei confronti degli eredi. Il caso più eclatante lo si è riscontrato con il sequestro dei beni dei Rappa, reiterato dalla Saguto l’ultimo giorno di scadenza dei cinque anni. Ma anche i beni di Gaetano Badalamenti vennero confiscati nel 2009, pochi giorni prima dello scadere dei cinque anni dalla sua morte. Stessa dinamica anche in questo ultimo caso. Si è arrivati allo scadere del quinto anno, altro che “sequestro a tempo di record”, come annunciato da chi lo ha proposto. In fondo questa è una delle tante crudeltà che caratterizzano la legge sulle misure di prevenzione. Quando uno crede, dopo quasi cinque anni di attesa, di avercela fatta, negli ultimi giorni si sente arrivare la mazzata sul capo. Il sequestro delle case di abitazione dei “preposti”, e il successivo abbandono al degrado, anziché alla ricerca di una soluzione che renda attivo il bene, anche con la collaborazione tra il preposto e l’amministratore, è un altro esempio della crudeltà con cui si agisce nei confronti di persone per le quali l’accusa di mafia in molti casi non ha alcun riscontro penale, ma solo la presunzione di colpevolezza affidata all’interpretazione del magistrato e del gruppo delle forze dell’ordine al quale vengono affidate le indagini, primo fra tutti la DIA.
Nel nostro caso si tratta di una consistente somma di denaro che dovrebbe confluire nel FUG, il Fondo Unico di Giustizia, istituito nel 2008 con la funzione di ricevere le somme di denaro e altri proventi derivanti da sequestri, anche nell’ambito di procedimenti penali, i cui fondi sono ripartiti tra il Ministero della Giustizia, il Ministero degli Interni e il bilancio dello stato, a parte un aggio del 5% che finisce nelle mani dell’Agenzia delle Entrate. Si tratta di un fondo i cui proventi sono e potrebbero ancor meglio essere utilizzati per preservare l’attività e i posti di lavoro delle imprese sotto sequestro giudiziario, che oggi, nella maggioranza dei casi vanno in malora.
