Casolare Badalamenti: il Comune di Cinisi può acquistarlo dietro pagamento di 73 mila euro al figlio del boss, che annuncia ricorso

La seconda sezione della Corte d’Assise di Palermo ha disposto che il Comune di Cinisi e l’Agenzia per i beni confiscati restituiscano, per equivalente, circa 71 mila euro in modo da acquisire definitivamente al patrimonio immobiliare del Comune il casolare di contrada Uliveto a Cinisi, che il suo proprietario Gaetano Badalamenti aveva ricevuto, per donazione, dalla sorella Fara, quindi trasmesso ai suoi due figli eredi e che, per un errore, non è stato chiarito imputabile a chi, non era stato inserito nell’elenco dei beni confiscati al boss di Cinisi nel 1992 dai giudici Falcone e Borsellino.

La Corte d’appello aveva già disposto la restituzione dell’immobile a Leonardo Badalamenti, ma aveva incontrato la netta opposizione del Comune di Cinisi e del suo sindaco Giangiacomo Palazzolo, poiché, nel frattempo, grazie a un finanziamento di circa 370 mila euro da parte del Gal golfi di Castellammare e Carini i ruderi del casolare erano stati interamente ristrutturati e il figlio del boss avrebbe beneficiato di tali lavori. Di là il ricorso e la richiesta del Comune di utilizzare la formula “per equivalente”, ovvero di pagare al proprietario l’immobile secondo il valore che aveva all’origine. La richiesta era motivata anche dalla destinazione data all’immobile come centro di attività sociali e istituzionali, prima fra tutte la valorizzazione della “vacca cinisara”, che, come si sa è un animale dop. A conferma di tale tesi il sindaco affidava, malgrado la sentenza di restituzione, il casolare all’associazione onlus Casa Memoria Impastato, che vi organizzava alcune iniziative, tra cui un convegno sui beni confiscati alla mafia, con la presenza di don Ciotti, e ne faceva la destinazione di visite guidate alle numerose scolaresche accolte giornalmente in quella che fu la casa di Peppino Impastato e di sua madre Felicia. La motivazione delle attività culturali e sociali al servizio della comunità ha ispirato la sentenza della Corte, presieduta dal giudice Vincenzo Terranova, che ha accettato la richiesta avanzata dal Comune di Cinisi dell’acquisto dell’immobile “per equivalente”, disponendo, dopo l’accertamento di un perito , che “”la finalità della norma è proprio quella di preservare, salvaguardando i diritti di chi è stato deprivato, anche erroneamente/illegittimamente, di un bene, il preminente interesse pubblico”

Alla fine secondo la Corte d’appello, nel 2014, anno dell’inizio della vertenza, all’immobile è stato attribuito una valore di 316.160 euro, e, considerato che il valore del restauro ammontava a 255.924, che andavano o rimborsati da parte del proprietario, in caso di restituzione, o decurtati in caso di acquisizione da parte del comune, si è arrivati alla somma di 60.236 euro, che, con interessi, inflazione e altre aggiunte ha portato il dovuto da pagare agli eredi di don Tano, da parte del  Comune e dell’Agenzia per i beni confiscati a 71.078,48 euro. Ma la vicenda non si chiude qui, perché Leonardo Badalamenti, attraverso i suoi legali Baldassare Lauria e Antonino Ganci ha annunciato ancora un ricorso, non intendendo rinunciare ai suoi “diritti” di proprietà dell’immobile, ubicato nella famigerata particella 134. Il valore stimato dalla Corte in quello che, prima del restauro era poco più che il rudere di una stalla, sembra ben al di là di quello effettivo, ma per Leonardo Badalamenti la proprietà della casa è diventata una “questione di principio”, confermata da due sentenze favorevoli. Quindi la storia continua. Nel frattempo, nel terreno circostante i ragazzi e le ragazze di Casa Memoria hanno piantumato alcuni alberi, ognuno dei quali è intestato a una vittima di mafia.
